Terms of Service and EULA
Covers the Hero EQ: Product Brain iPhone app and this website. Last updated October 25, 2026.
The short version
- Hero EQ is a tool that helps you think through product work. You stay in charge of what you decide and what you share.
- Your content is yours. We don't take ownership of it.
- AI answers can be wrong. Check anything important before you act on it.
- Only put in material you're allowed to use, including anything that belongs to your employer.
Who we are and what these terms cover
Hero EQ (the iPhone app "Hero EQ: Product Brain") is made by HEROMINUTES, LLC ("we", "us"). These terms are the agreement between you and us for using the Hero EQ iPhone app and this website. How we handle data is explained in our privacy policy, which is part of this agreement. These terms are also our end user license agreement (EULA) for the Hero EQ iPhone app, which replaces Apple's standard EULA for it. If you downloaded the app from the App Store, Apple's Media Services Terms also apply to you, and if they conflict with these terms on the points they cover, Apple's terms win.
In these terms, “we”, “us” and “our” mean HEROMINUTES, LLC. Where these terms limit or exclude responsibility, they protect HEROMINUTES, LLC and also its members, managers, officers, employees, contractors, agents, affiliates, licensors and successors (together, the “HEROMINUTES parties”), each of whom may rely on those terms.
By installing or using Hero EQ you agree to these terms. If you don't agree, please don't use it.
End user license agreement (EULA) and Apple's required terms
This section is the licence for the Hero EQ iPhone app, and it contains the terms Apple requires in a developer's own EULA. The rest of these terms apply with it.
- Acknowledgement. This EULA is between you and HEROMINUTES, LLC only, not Apple. We, not Apple, are solely responsible for Hero EQ and its content. Nothing in these terms sets usage rules that conflict with Apple's Media Services Terms.
- Scope of the licence. We give you a limited, non-exclusive, non-transferable, revocable licence to install and use Hero EQ on Apple-branded devices that you own or control, as the Usage Rules in Apple's Media Services Terms allow (including Family Sharing and volume purchasing where they apply), for your own use. You may not copy, modify, rent, lease, sell, sublicense or distribute Hero EQ, or try to extract its source code, except where the law allows it regardless of this term. We keep every right we don't expressly give you.
- Maintenance and support. We alone are responsible for any maintenance and support for Hero EQ (see Support). Apple has no obligation whatsoever to provide any maintenance or support for it.
- Warranty. If Hero EQ fails to conform to a warranty that applies to it, you may tell Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent the law allows, Apple has no other warranty obligation for Hero EQ. As between you and Apple, any other claim, loss, liability, damage, cost or expense caused by a failure to conform to a warranty is our responsibility, subject to the limits in these terms. These terms disclaim other warranties as far as the law lets us.
- Product claims. As between you and Apple, we, not Apple, are responsible for dealing with any claim you or anyone else makes about Hero EQ or your use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection or privacy claims. Nothing in these terms limits our liability beyond what the law allows.
- Intellectual property. If a third party claims that Hero EQ or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You confirm that you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Who to contact. Hero EQ is published by HEROMINUTES, LLC. Send questions, complaints and claims through our contact form.
- Third-party terms. You must follow any third-party terms that apply when you use Hero EQ, such as the terms of the AI provider whose key you use, your Apple Account terms and your employer's policies.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this EULA. When you accept it, Apple has the right (and is taken to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
Your licence ends automatically if you break these terms. When it ends you must stop using Hero EQ and delete it from your devices.
Who can use it
Hero EQ is built for working professionals. You must be at least 18, or old enough to make a binding agreement where you live. If you use it for work, you confirm you're allowed to.
Your content
- You own it. Your decisions, chats, photos, files, notes and recordings stay yours. We don't claim any rights to them.
- You're responsible for it. Only add material you have the right to use. If it belongs to or concerns your employer, a client or another person, make sure you have permission, and follow your employer's rules on confidential information and on AI tools.
- Sending it to AI services. When you ask the app to use an AI service, your content goes to the provider you chose, as the privacy policy describes. That provider's own terms and privacy policy apply to what it receives. If you use your own key, your agreement with that provider is between you and them.
- Recording people. Laws about recording conversations vary, and some places need everyone's consent. The app asks you to confirm before each interview recording, but getting consent is your responsibility.
- Feedback. If you send us feedback or a tool vote, we may use it to improve Hero EQ without owing you anything for it. Please keep confidential work material out of it.
AI answers are not advice
Hero EQ uses AI models to draft answers, plans, summaries, decks and numbers. These can be incomplete, out of date or simply wrong, and two answers to the same question can differ. They are a starting point for your own judgment, not professional, legal, financial, tax, investment or accounting advice. The Business case team's figures are estimates built from what you give it. They're not a forecast or a guarantee, and you should check them before you rely on them. You're responsible for the decisions you make and anything you send, publish or export. You use answers at your own risk, and none of the HEROMINUTES parties is responsible for any decision, product, plan, figure, message or filing that relies on them. Answers that use your project documents or the rules you set can still miss a passage or a rule: check them against your own files.
Using the app properly
Please don't:
- use Hero EQ to break the law or someone else's rights, or to record or collect information about people without the consent the law requires;
- try to break, overload or get around the app's limits, locks or security, or the servers behind the account;
- copy, resell or reverse engineer the app, except where the law allows it regardless of this term;
- use another person's account, or an API key that isn't yours.
Your account
You need to sign in with Apple the first time you open Hero EQ, and you're responsible for what happens under your account. Hero EQ does not provide an AI service of its own at launch. To get AI answers, you add your own Claude or OpenAI key (you pay that provider directly, under your own agreement with them), or use Apple Intelligence on your device where your iPhone supports it. You can delete your account at any time with "Delete account" in Settings. That removes your account and plan from our servers. To prevent abuse we keep an anonymous record of the purchase (Apple's transaction number, dates and usage counts, with no name, email or content), as the privacy policy describes. Deleting your account does not cancel a subscription: see "Paid plans".
Paid plans
- What it is. Hero EQ Platform is an auto-renewing monthly subscription, available in the United States and Canada, for $9.99 a month. The price shown by the App Store when you subscribe is the price that applies. It unlocks all of Hero EQ: capture, Ask, Library and Projects. It does not include AI answers from us: you bring your own Claude or OpenAI key, or use Apple Intelligence, as described above. Family Sharing is not available.
- Free trial. New subscribers get a 7-day free trial. Apple allows one free introductory offer per person for a subscription group (it is tied to your Apple Account), so you can use the trial once. To avoid being charged, cancel before the free trial ends.
- Billing and renewal. Apple charges your Apple Account. The plan renews every month until you cancel.
- Cancelling. You can manage or cancel your plan at any time in your Apple account settings (the app has a Manage subscription button). Deleting the app or deleting your Hero EQ account does not cancel it; Apple keeps billing until you cancel.
- Refunds. Apple handles payment, so Apple's rules on billing, renewals and refunds apply. If Apple refunds a purchase, the plan ends.
- Without a plan. After a trial ends or a plan lapses you keep your work: you can read and export it, delete your data, delete your account and manage your subscription. New AI answers, captures and new records need a plan.
A plan can change what it includes, but it will never take away your right to delete your data or to lock the app.
Our software and brand
The app, its design, the Hero EQ name and logo, and the specialist prompts and team designs belong to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for as long as you follow these terms. Apple, the App Store and Face ID are trademarks of Apple Inc.
Third-party services
Hero EQ connects to services we don't run, such as Anthropic, OpenAI, Apple, Linear, Slack, Jira, Notion and Supabase. None of the HEROMINUTES parties is responsible for those services, for changes to them, or for how they handle what you send them, including anything you send to an AI provider under your own key or account. They can change, fail or stop working at any time.
Founder Principles and published ideas
Founder Principles applies ideas from the published writing, talks and interviews of well-known founders. What it produces is an AI's application of a published idea. It is not a statement, advice or endorsement from any of those people or from the companies they run or work for, and Hero EQ is not affiliated with, sponsored by or endorsed by any of them. Their names, marks and writing belong to their owners. Sources can be incomplete, out of date or misread, so check the source before you rely on an idea. None of the HEROMINUTES parties is responsible for what a person or company said, did or published, or for how you use it.
Your responsibility
You use Hero EQ, and everything it produces, at your own risk and on your own judgment. You are responsible for your work and your decisions: for what you add to the app, for checking its answers, for what you send, share, publish or export, and for following your employer's policies and any confidentiality or contract duties you owe. None of the HEROMINUTES parties is responsible for how your employer, a client, a regulator or anyone else reacts to what you put into the app or do with its answers, or for any breach of a policy or duty that you or your organisation owe.
To the fullest extent the law allows, you agree to defend, indemnify and hold harmless the HEROMINUTES parties from any claim, loss, liability and cost (including reasonable legal fees) that arises from your content, your use of Hero EQ or your breach of these terms.
No guarantees
The HEROMINUTES parties provide Hero EQ “as is” and “as available”. To the fullest extent the law allows, they give no warranty or condition of any kind, express or implied, including any about merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, quiet enjoyment or availability. They don't promise that Hero EQ or any AI answer will be uninterrupted, error free, secure in every circumstance, current or right for your purpose, or that it will produce any particular result. AI answers are generated and can be wrong. Some places don't allow these exclusions, so they may not apply to you.
Limits on our responsibility
To the fullest extent the law allows, none of the HEROMINUTES parties is liable for any indirect, incidental, special, consequential, exemplary or punitive loss, or for any loss of profit, revenue, business, opportunity, data or goodwill, or for any decision made or action taken because of Hero EQ or its answers, however caused and on any legal theory (including negligence), even if we were told it could happen. The total liability of all the HEROMINUTES parties to you for everything connected with Hero EQ is limited to the amount you paid us for it in the 12 months before the claim, or US$50 if you paid nothing. Any claim connected with Hero EQ or these terms lies against HEROMINUTES, LLC only, and not against its members, managers, officers, employees or contractors personally.
Nothing in these terms limits liability that the law doesn't allow to be limited, such as for fraud or for death or personal injury caused by negligence, or removes rights you have as a consumer.
Ending things
You can stop using Hero EQ at any time by deleting the app. We may suspend or end your access, including your account, if you break these terms or if keeping it going would put others or the service at risk. We may also change or stop parts of Hero EQ, and will try to give notice where that affects something you pay for. Sections that by their nature should survive (such as those on ownership and liability) continue after access ends.
Changes to these terms
We may update these terms, for example when we add features. We'll change the date at the top, and for material changes we'll tell you in the app or by email if you've given us one. If you keep using Hero EQ after a change takes effect, you accept the new terms.
General
These terms, together with the privacy policy, are the whole agreement between you and us about Hero EQ. If any part is found invalid or unenforceable, that part is limited to what the law allows and the rest stays in force (severability). If we don't enforce something straight away, we haven't given it up. You may not transfer your rights under these terms; we may transfer ours, for example if the business changes hands. Headings are for convenience only.
Governing law and where disputes are heard
These terms, and any dispute or claim connected with them or with Hero EQ, are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. You and we each agree that the state and federal courts located in Wyoming have exclusive jurisdiction over any such dispute, and each of us submits to those courts.
If you use Hero EQ as a consumer, this section does not take away any mandatory consumer protection or other rights that the law of the place where you live gives you and that cannot be waived by contract, including any right to bring a claim in the courts of your home country. Apple's own terms for the App Store have their own governing-law provisions, which this section doesn't change.
